NOTICE OF PROPOSED CHANGES TO THE LOAN PARTICIPATION PROGRAM, CONDUIT REVENUE BOND, AND PROCUREMENT REGULATIONS OF THE ALASKA INDUSTRIAL DEVELOPMENT AND EXPORT AUTHORITY The Alaska Industrial Development and Export Authority (Authority) proposes to adopt regulation changes in Title 3 of the Alaska Administrative Code that pertain to the Loan Participation Program, the Issuance of Conduit Revenue Bonds, and procurement regulations. These changes include amendment or repeals of provisions in the Loan Participation Program under 3 AAC 99.250 which facilitates economic development by purchasing participations in loans originated by qualified financial institutions. Specifically, 3 AAC 99.250 and 3 AAC 99.350 make reference to the Bank of Des Moines Fixed Rate Advances Index to set interest rates. The Federal Home Loan Bank of Des Moines has adopted policies which make continued reliance on the Index no longer feasible. This means the Authority must adopt in regulation a new widely published index, such as the U.S. Treasury Bills, Notes, and Bonds Index as listed in the Wall Street Journal. There is also a need to update 3 AAC 99.350 which deals with loan modifications as the regulation no longer aligns with current policies of the Authority regarding modification of loan terms and to remove a reference to the Bank of Des Moines Fixed Rate Advances Index regarding interest rates for the program. The Authority also proposes to amend its regulations for the revenue bond program as set forth in 3 AAC 99.140 and the application fee for a bond set forth in 3 AAC 110(b). AIDEA proposes to increase bond issuance fees by charging a higher application fee and aligns with other entities regarding processing and other ongoing fees over life of the bonds to defray costs of monitoring the bond and providing for accounting and book carrying costs. The Authority further proposes to amend its procurement regulations by adding provisions to allow for the use of "Indefinite Delivery, Indefinite Quantity" OR IDIQ contracts. The regulations would allow the Authority to select multiple contractors to provide an unspecified amount of services or supplies or equipment within a set time frame. Under the regulations, the Authority could negotiate a price with more than one contractor(s) for a preset minimum quantity of goods or services for a set period of time. Ultimate use of the contractor or different contractors on a project or among projects would depend on the circumstances during the contract period. The contract ends after the set time period. Awards would be primarily based on experience, history of completion of projects on time and on budget, and other factors. 3 AAC 100.050(b) would be amended to also add a reference to AS 44.88.830(a)(6).
