Description and Project Proposal Applicant proposes a development agreement for two parcels abutting US 2 and totaling approximately 15 acres. The proposed development agreement would address certain vested rights, permitted uses, and the cooperation and coordination of improvements to develop the area into highway-oriented commercial uses. Finalization of an approved development agreement would entitle the property prior to development. The conceptual site plan of the proposed development agreement anticipates 90,260 SF of building space at full buildout, including a 50,000 SF supermarket, quick service restaurants, and other commercial and retail businesses associated with a shopping center. II. SUMMARY OF DECISION The City of Sultan Municipal Code (SMC) categorizes a development agreement (DA) as a Type IV permit, per Table 16.06-A which is a legislative decision that involves a recommendation made by the Planning Board to the City Council. City Council must hold a public hearing prior to adopting and approving a development agreement by resolution or ordinance. The decision is appealable to the Snohomish County Superior Court. The review and approval criteria for a development agreement is codified in SMC 16.06. The DA application was submitted on November 20, 2025. The application was deemed complete on December 29, 2025. Per SMC 16.06.030.D.1., a determination of completeness must be completed within 28 days. The applicant agreed to extend this date due to additional time required to complete the economic analysis component of the project as a deferred submittal. Additionally, Table 16.06-C and SMC 16.06.030.G.f requires a permit decision on this application within 170 calendar days from the determination of completeness unless the applicant and City agree in writing to a waiver of the clock, if applicable. The City and applicant mutually agreed on this waiver on June 12, 2026. Staff administratively reviewed the project for compliance with the policies, standards, and regulations of the City of Sultan through formal development review and further analysis applied via staff report. On June 16, 2026, a public hearing was held during the Planning Board Special Meeting. Public testimony was received and reviewed by staff for applicability to code requirements. The Planning Board recommended approval of the project, per the staff recommendation by a vote of 4-0 with 1 abstention. A second public hearing was held on July 9, 2026 at the regular City Council meeting. Public testimony was received and reviewed by staff for applicability to code requirements. On July 9, 2026, the City Council formally adopted Resolution No. 26-08 authorizing the Mayor to sign the development agreement with an effective date of July 9, 2026. The applicant must record the development agreement with Snohomish County as the final step. Note: In April 2026, the name of the property owner changed from Drivstuen Investments LLC to Cascade Commercial Park II LLC. As both LLC’s have the same registered agent, the text of the language of the Development Agreement remains the same.
