SEPA Rules - WAC 197-11-970 Mitigated Determination of Non-Significance (MDNS) 431 Terra Eden Three-Unit Small Inn Applicant: Douglas-Fir Project, LLC Jacob Norstrom, on behalf of applicant 1930 Calawah WayForks, WA 98331 Location of Property: 431 Terra Eden, Forks, WA Legal Description: Property: Lot 9, Block 3 of Copeland's Third Addition to Forks as found in Volume 4 of Plats on Page 30, located within the SE % of the NW % of the NE %, Section 9, Township 28N, Range 13 W, W.M. in Clallam Co. WA. Lot size 0.15 acre Tax Id. Parcel 132809700216 Project Description: Jacob Norstrom, as both an owner of record and on behalf of Douglas-Fir, LLC is seeking a conditional use permit for a project that will include the building of a tri-plex that may be utilized in its entirety as a small inn. The new construction will develop a three-unit, 2,055 sq. ft. building that the proponents intend to be “mixed used short-term, mid-term, and long-term housing.” If all three units were to be utilized as short term housing, the new building would be classified as a ‘Small Inn’ under the City’s zoning code. See FMC 17.10.055. Property is zoned ‘Moderate Density Residential,’ and a small inn requires a conditional use permit. Property is accessed from paved City streets; can access city water; would utilize on an on-site septic system; electrical provided by the PUD; and telecommunications access via CenturyLink. Lead Agency Rod Fleck, City Attorney/ Planner City of Forks 500 East Division, Forks, Washington 98331 Proposed Project: Development of a 0.5 acres lot with the construction of a new three-unit structure totaling 2,055 sq. ft. with all units being permitted for short-term rentals. The proponent may lease units in a combination of short-term/vacation rentals, month to month, or longer terms. Prior SEPA Documents: None associated with this proposal. Mitigation required: 1. Applicant will be required to obtain a Conditional Use Permit from the Forks Planning Commission which is scheduled to hear that request at a public meeting on 21 October 2026 for which notice is being published at the same time as this MDNS. 2. Applicant will need to obtain a Forks Building Permit which may be subject to commercial plan review requirements as determined by the City’s Building Official. 3. Applicant or Applicant's contractor must be required to immediately notify the City there is any discovery of any archaeological resource(s), as well as any discovery of human remains. Applicant or Applicant's contractor will notify the owner who will in turn notify the City of Forks (Forks Police Department and City Attorney's Office), the Quileute Tribal Council the Hoh Tribal Council, and Washington State Department of Archaeology and Historic Preservation. If any discover were to occur, Applicant must ensure that all work on the site will immediately stop until consultations have occurred with the above-named notified parties. 4. New unit must be placed in a manner to meet all zoning code setbacks. 5. If fill material is utilized, fill must come from a clean source 6. All stormwater drainage must be constructed to ensure that: a. it is kept on site; b. if applicable, the drainage system's dry wells or similar such devices are registered in accordance with the Department of Ecology's injection well registration requirements; and, c. that the drainage system is reviewed by the Building Inspector prior to construction. d. Efforts will also be made to contain stormwater on site during the construction period of the project. 7. If an additional access from either City street is to be utilized, the Applicant will obtain any necessary driveway permit for this additional access point. 8. All utility connections must be done pursuant to the utility providers' requirements in a manner that meets local, state and/ or federal code requirements. 9. Exterior lighting of the building will be installed in such a way to ensure that lighting is directed downward and remains primarily on-site. The Lead Agency has determined that the above items do not have a probable significant adverse impact based upon the proposed mitigation required above. An environmental impact statement (EIS) is not required under RCW 43.21C.030(2). This decision was made after reviewing a complete environmental checklist and other information on file with the lead agency. This information is available to the public on request. This MDNS is issued under 1 97-11-340 (2); the lead agency will not act on this proposal for a period of 1 4 days from the date of issuance to allow for agency review and comment, as well as comments from the general public. Comments must be submitted to the City Planner at: Rod Fleck, City Attorney / Planner Forks City Hall 500 East Division, Forks, Washington 98331 Comments will be accepted up to 5 p.m., 14 October 2026. The City will review said comments together to determine the impact upon the stated MDNS. Submitting comments is not the same as a written appeal of this determination or asserting lead agency status.
